Hacker Gary Bowser from the Team Xecuter team was sentenced to more than 3 years (40 months) in prison for hacking the Switch with SX OS. The United States Department of Justice details the sentence.

Gary Bowser and his Team Xecuter sold SX OS, a tool that allowed you to hack the Switch in order, in particular, to play any game for free. As you can imagine, it was anything but legal and Nintendo has everything done to stop this market.
You should know that Team Xecuter was not at its first attempt. Indeed, the team has already been responsible for hacking several consoles, including the NES Classic Edition, PlayStation Classic, and Xbox.
Gary Bowser’s role was “to administer websites that communicated with customers and offered devices for sale”, according to the Department of Justice. The 52-year-old Canadian pleaded guilty to two felony charges in October 2021, and today’s Justice Department release says that as part of his plea deal, Bowser agreed to pay 4.5 million dollars in restitution to the American branch of Nintendo.

The sentencing is the final step in what has been a saga. Gary Bowser was arrested in the Dominican Republic in September 2020 and deported to the United States. He has been in federal custody since his arrest. In December, he agreed to pay $10 million to settle a lawsuit filed against him by Nintendo.
He was not alone in this matter. Max Louarn, a 49-year-old Frenchman from Avignon and Yuanning Chen, a 36-year-old Chinese man from Shenzhen, are both charged in the indictment. Neither is currently in federal custody.
It should be noted in passing that the family name Bowser can make you smile. The hacker has the same name as the main antagonist of the Mario games universe. Moreover, the boss of the American branch of Nintendo is called… Doug Bowser. You can not make that up !
